False Information in Defamation Case Results in Incarceration

Woman in Her 30s Imprisoned for Fabricating Rape Allegations, Reflecting Enhanced Legal Sanctions

A woman in her thirties has been sentenced to imprisonment after she falsely accused her father, who had financially supported her overseas education, of being a rapist following his refusal to provide her with money.

As reported by the legal community on the 1st, the Criminal Division 1 of the Namyangju Branch within the Uijeongbu District Court, under the oversight of Presiding Judge Choi Chi-bong, has recently handed down a 10-month prison sentence to a woman identified as A. The charges against her include defamation, business obstruction, and insult.

A faced trial for repeatedly posting defamatory content in an online community from May to June of the previous year. Under the title "I am a victim of familial sexual violence. Please look at this," she targeted her biological father, B, with these allegations.

In these posts, she falsely alleged, "I have been sexually abused by my biological father since the age of four, and my mother also suffered domestic and sexual abuse," adding that "the issue was resolved with 30 million won in compensation," and calling for "severe punishment."

During these events, A also revealed B's full name and business details. Consequently, B reportedly encountered significant challenges in managing his business.


 


Additionally, A made six posts claiming that B had remarried a woman, referred to as C, with whom he was previously involved in an affair.

In February 2021, A initiated a lawsuit at the Incheon District Court seeking damages for sexual assault against B. However, she failed to substantiate her claims with any evidence of illegal activities.

Throughout the criminal proceedings, A maintained the truthfulness of her statements, but the court rejected her defense based on the previous lawsuit outcome. The court noted the absence of credible evidence or circumstances to support A's allegations of habitual sexual abuse by B.

The court deemed A's claims as fabricated, considering her financial dependency on B during and after her overseas education. The timing of her accusation shortly after B's refusal to fund her café venture further supported this view.


The court stressed, "She disseminated false allegations against the victims due to her dissatisfaction with the withholding of financial support. The damage to the victims’ reputations is irreparable."


The court elaborated on its sentencing decision, noting, "Given the significant risk of reoffending as evidenced by her continued similar postings even after the initial crime, alongside the victims' strong demand for stringent punishment, these elements were carefully evaluated."
